Separation & Divorce

Nobody plans on getting separated or divorced. Many people feel that going through such an event is one of the most traumatic experiences of their lives. At Euroa Law Group, we understand the complex and emotional nature of a separation and/or divorce, and we are here to guide you through it using whatever process or processes make the most sense for you and your family.

Alternative Dispute Resolution

ADR is an umbrella term for a group of legal dispute resolution processes that take place outside of court. ADR offers parties to a family law dispute a path toward resolution that is more cost effective, timely, and, oftentimes, less stressful. At Euroa Law Group, our lawyers are all trained and experienced in multiple forms of ADR to assist you in reaching a comprehensive resolution to your family law matter without having to go to court. We provide services relating to mediation, arbitration, mediation-arbitration, parenting coordination and Collaborative Practice.

Mediation

In the mediation process, a neutral third-party, facilitates the resolution of a family law dispute by guiding the parties toward settlement. A mediator identifies issues in dispute, and helps families focus and narrow their differences to achieve a solution that addresses the specific needs of the family.

At the Euroa Law Group, we work with families to support and represent them to help achieve meaningful resolutions through the mediation process.
The Euroa Law Group provides families with full mediation services through our experienced and accredited family law mediators.  We welcome families who are either supported by counsel or are self-represented.

Arbitration

When families are unable to reach an agreement through negotiation or mediation, they can jointly elect to have their dispute resolved out of court, through the private and binding process of arbitration. An arbitrator will deliver a binding decision after reviewing the evidence of the parties.

Arbitration provides families with the ability to design a streamlined process with their counsel that can support a faster and less expensive final resolution to their family law issues for the benefit of the family.

At the Euroa Law Group, we represent families at arbitrations and also act as arbitrators to make binding decisions for families.

Mediation-Arbitration

This is a hybrid ADR model that combines mediation and arbitration. In this process, the parties agree to first attempt to resolve their issues through mediation. In the event that mediation fails, or does not result in a full settlement, the parties agree to then participate in arbitration to achieve a binding award relating to the unresolved elements of the family law dispute. The mediator and arbitrator are often the same person in these cases, though not always.

We represent families at mediation-arbitrations and also act as mediators and arbitrators to make binding decisions for families.

Collaborative Practice

This is an ADR model to resolve matters out of court.  It is a positive alternative to parties who prefer maximum control of their family law issues and seek to resolve their disputes with their partner in a respectful, civil and reasonable way.

In Collaborative Practice the parties will each retain collaboratively trained family lawyers who will work together as a team to achieve the desired outcome of the parties through a separation agreement. Collaborative Process allows for the parties to jointly retain collaboratively trained family and financial professionals to provide expert assistance to the parties and their counsel to provide a holistic approach to minimize the stress and anxiety that often occurs with separating or divorcing parties.

Litigation & the Court Process

Family law litigation and court appearances are inherently stressful and emotional. At Euroa Law Group, our experienced lawyers have represented clients at all court levels in Ontario, including the Ontario Court of Justice, the Superior Court of Justice, and the Court of Appeal, on a wide variety of legal issues.

Domestic Contracts

We have assisted countless couples with the negotiation, preparation, and execution of domestic contracts, and we provide clients with independent legal advice throughout the entire process.

Parenting Coordination

is a service for parents who require assistance to resolve ongoing disputes arising from the implementation of their agreed upon parenting plan, separation agreement or the parenting terms of a Court Order and do not want to go to court.  The parents   work with a parenting coordinator, who is a neutral third-party, to assist them in resolving their day-to-day disputes.  The parenting coordinator will assist the parents to develop strategies to develop healthy communication, conflict resolution and enhance problem-solving skills to support the co-parenting relationship.

At the Euroa Law Group, we provide parenting coordination services through an experienced family law lawyer who will work with parents to resolve their parenting disputes to support and advance the welfare of the children and the family.  Our parenting coordinator will assist the parents through education, mediation and, when required, make a binding decision to support timely resolution of areas of parenting disputes.  The ultimate goal is for parents to utilize the strategies that they have learned so that they will no longer require assistance from the parenting coordinator and be able to effectively co-parent.

Adoption

At Euroa Law Group, we represent individuals and couples who are either looking to adopt children or whose children are the subject of an adoption process. Our lawyers maintain a child-centred approach; we are principally focused on respecting, upholding, and promoting the best interests of the children in all cases.

Child Protection

At Euroa Law Group, we pride ourselves on our expertise in children’s issues, particularly in the domain of child protection. The involvement of the Children’s Aid Society is never a parent’s plan nor desire, and it is often a difficult and stressful event for both children and parents alike.

Our lawyers understand the significance and emotional nature of child protection investigations and the impact it has on families. We take a compassionate approach to child protection services and advocate for you to the Children’s Aid Society throughout the investigation and thereafter.
